We respect your privacy and are committed to protecting your personally identifiable information (“PII”) or personal data. This Privacy Policy will provide you information about how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you. 

This Privacy Policy aims to give you information on how we collect and process your PII, including any data you may provide through, or as a result of your use of, our website, when you contact us or when you purchase products from us.

1 Who we are

This Notice relates to our collection and processing of personal information in the United Kingdom, including on the Blueair, Inc. website (“Website”).
For the purpose of the UK Data Protection Act 2018, which implements the General Data Protection Regulation 2016/679 (“the GDPR”, as may be amended from time to time), Blueair, Inc. (“Blueair”) and Stearn Electric Company Ltd. T/A Beam Group (“Beam”) are Joint Data Controllers. This means that both businesses work together to decide why and how your personal information is processed. It also means that we are jointly responsible to you under the law for that processing.

In this policy, unless otherwise noted, references to “we,” “us” or “our” refer collectively to Blueair, Inc. and Stearn Electric Company Ltd. T/A Beam Group, registered in England and Wales under company number 0201097, with its registered office at Votec House, Hambridge Lane, Newbury, Berkshire, RG14 5TN, United Kingdom.

We are committed to protecting and respecting your privacy. The purpose of this Policy to explain how we collect, use and secure personal information collected on the Website or directly supplied by you. This policy describes our data protection responsibilities for PII that is shared between us.  It also describes what types of information is shared about you, how it is used by us, how we share the information with others, how you can manage the information we hold and how you can contact us.

2 Key Definitions

2.1 Personally Identifiable Information (“PII”) means any information relating to an identified or identifiable natural person, including an individual’s name, contact information and title, . For the purposes of the GDPR, an individual’s internet protocol address (“IP address”) may be considered PII.

2.2 Tracking Technologies means cookies, web beacons, serving tracking technologies or other technology solutions performing similar functions. These technologies may include first party cookies (cookies referencing the domain of the website being visited) and third-party cookies (cookies referencing a domain other than the one of the website being visited) those placed by a website other than the one being visited), local shared objects (commonly referred to as “Flash Cookies”), HTML 5 Cookies and tracking pixels (including transparent or clear gifs).

2.3 User or you mean any individual who views or interacts with the Websites, whether or not they are a Customer or a Potential Customer.

3 What Information do we collect and how is it collected?

3.1 Personally Identifiable Information (PII)

We collect and process PII limited to information necessary to achieve one or more legitimate business purpose as described in this Policy. PII may include:  

  • Basic information such as your name, address, telephone number or email address
  • Records of any correspondence in the event that you contact us
  • Records of any purchases you make through the Website
  • Details of your visits to our sites and the resources you access
  • Details of your marketing preferences
  • Technical data such as your Internet Protocol address (IP address), browser type and version and information about how you use and access the Website (see below ‘Information that we acquire indirectly’).

Except where you provide your PII to us in accordance with the above, we will not collect or store it without first asking you for it.

3.2 Information that we acquire indirectly

We may collect information about your device including, where available, your IP address, operating system and browser type. We may gather certain information about your use of our sites, such as information about your visit and interaction with our Content.

3.3 Cookies

One of the ways in which we collect technical information is through Tracking Technologies such as cookies. Cookies are small text files containing information that is stored on your device. They help us to improve our site and to deliver a better and more personalised service. They enable us to:

  • Estimate our audience size and usage pattern
  • Store information about your preferences, and so allow us to customise our site according to your individual interests
  • Speed up your searches
  • Recognise you when you return to our site

We will seek your consent to use cookies the first time you visit our site (or on subsequent occasions if the cookie that records such acceptance is deleted). However, you may not be able to use all the interactive features of our site if consent is not given.

The cookies used by our site and their purpose are identified and described below:

3.4 Other Information

Our site may from time to time contain links to and from other websites operated by Blueair or Beam, or the websites of our partner networks and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies. You should read those privacy policies carefully so that you understand how your PII is processed through those websites. We do not accept any responsibility or liability for the policies of our partner networks or affiliates. Please check these policies before you submit any personal information to these websites.

Please note that where we need to collect PII by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with products that you request). In this case, we may have to cancel your order we will notify you if this is the case at the time.

4 What are our roles in relation to the handling of your PII?

4.1 Beam is the business that has primary responsibility for the day-to-day handling of your PII as it collects this information and has direct contact with you. Beam, as Blueair’s distributor, is the company you contract with when you purchase any goods from the Website and it is with Beam that you have a contractual relationship. As a result, Beam is responsible for the following activities relating to the processing of your PII:

  • Acting as your main point of contact for any queries you may have relating to this Privacy Policy.
  • Responding to any requests by you to exercise your rights as a data subject under the data protection legislation (as to which see the section below on 'Access to Information, Opting Out and Your Privacy Rights’).
  • Making sure it has a lawful basis for sharing your PII with Blueair (this is the legitimate interests of us both – as to which see the section below on ‘What is the lawful basis for processing your PII).
  • Producing this policy, and making the information it contains available to you, jointly with Blueair.
  • Ensuring that the personal information it stores is secured and retained in accordance with data protection laws.

4.2 Blueair is the manufacturer and supplier of the products sold through the Website. Blueair engages Beam as its distributor and allows Beam to operate the Website in the UK using its name and logo. Blueair is the party with ultimate control of the contract with Shopify for the operation of the Website. Its data protection responsibilities to you, therefore, include:

  • Ensuring it has the legal grounds to process your PII in the ways set out in this Policy.
  • Producing this Policy jointly with Beam.
  • Ensuring Shopify (as the platform operating the Website) handles your PII in accordance lawfully and in accordance with its documented instructions only.
  • Responding to you if you contact Blueair in order to exercise any of your rights as a data subject (as to which see the section below on 'Access to Information, Opting Out and Your Privacy Rights’).
  • Ensuring it has in place legal grounds to process your PII in the ways set out in this Policy.

4.3 We share your PII as set out in this Privacy Policy between us for the purposes of providing you with products which you have purchased, answering your questions, queries or complaints and promoting Blueair products which we think may be of interest to you to you. We only share, process and retain PII which is necessary, relevant and adequate for the purposes described in this Policy. This information is provided so that we can provide you with a holistic service and excellent customer care as is in our legitimate interests to do.

5. How is your Information used?

5.1 We use the information that we collect about you to:

  • Provide you with products, services, publications, and information that you request, access, or which may be of interest to you.
  • Deliver or display content that matches your interests and responsibilities.
  • Contact you with information about, and invitations for, products and services from us directed to your interests and responsibilities. We may use your PII to form a view on what we think you may want or need, or what may be of interest to you and in doing so we will only send information that is deemed relevant to you.

    This is necessary for our (Blueair and Beam’s) legitimate interests in growing and developing our businesses including the sale of Blueair products.

    You will receive marketing communications from us (either as joint communications or separately from Blueair and/or Beam) if you have requested information from us or purchased products from us and, in each case, have not opted out of receiving that marketing.

    We will however ask for express consent before we share your PII with any other third party for marketing purposes.

    You can ask us to stop sending marketing communications at any time by contacting us.
  • Perform our contractual obligations to you and deliver products which you order from us.
  • Answer your questions and respond to your enquiries or complaints.
  • Comply with our legal and/or regulatory obligations.

5.2 We may analyse information collected from you indirectly to:

  • Help us recognise your computer as a previous visitor and save/remember any preferences that you may have while you were visiting one of our sites.
  • Help us improve our content and our sites.
  • Identify trends, statistics and measurements that could contribute to the enhancement of our services.
  • Identify market sensitivities and relative market interest in specific product categories. We may also use the information that we collect to send you satisfaction questionnaires, surveys, and marketing information.

6 Why do we collect your Information?

6.1 We will only collect and use your PII when the law allows us to.  

6.2 We collect information about you in order to improve our relationship with you and to offer you opportunities to obtain our products and services relevant to your interests.   Collecting this information helps us tailor our products and services to you and therefore communicate with you more effectively. We are aware that many of our Customers make use of a range of media channels so we may also provide a mechanism through which you can express preferences about how you want us to communicate with you.

6.3 Collecting your information makes it possible to:

  • Operate our businesses more effectively in accordance with our legitimate interests.
  • Answer your questions or enquiries as it is in our legitimate interests to do.
  • Process your orders and delivery products to you including allowing us to manage payments.

    This is necessary for the purpose of performing our contract with you.
  • Deal with complaints in accordance with a statutory obligations and in accordance with our legitimate interests.
  • Market Blueair products to you as is in our legitimate interests
  • Protect our businesses and our Website, including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data.

    This is necessary for our legitimate interest in running our businesses, to prevent fraud and in the context of a business reorganisation, sale or group restructuring exercise, and for compliance with our legal obligations.
  • Help us to improve the content of the website and to customise the content or layout of the website for you, in accordance with our legitimate interests.

    This is necessary for our legitimate interest in defining types of customers for our products and services, to keep our website updated and relevant, to develop our business and to inform our marketing strategy.
  • To find out things such as the number of visitors to the various parts of the Website, and to help us to improve the content of the Website and to customise the content or layout of the Website for you, in accordance with our legitimate interests.

    This is necessary for our legitimate interest in defining types of customers for Blueair products, to keep the Website updated and relevant, to develop our businesses and to inform our marketing strategy.
  • Comply with a legal or regulatory obligation, including the prevention of crime.

7 What is the Legal Basis for the Processing of PII?

7.1 Depending on the nature of the relationship and the purpose in each case, we rely upon consent, contract and legitimate business interests for processing PII. For example, we may process PII with a User’s consent when they agree that we may place cookies on their devices, or that we can process information that they enter into a form on one of our sites. Where we obtain your consent to the processing of your PII you have the right to withdraw your consent at any time by contacting us.

7.2 It is in our interest as a business to enhance the services that we provide which may include processing your information to enable us to:

  • Respond to User enquiries and to fulfil User requests.
  • Send Customers or Potential Customers relevant marketing information and offers.
  • Complete transactions and process orders you place on our site.
  • Provide customer service.
  • Send administrative information.
  • Personalise Users’ experiences with our sites.

7.3 Where we process your PII for our legitimate interests we make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your PII. We do not use your PII for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

7.4 We also process your PII  where we are required to by law or where we have a regulatory obligation to do so.

7.5 We process certain PII to enable us to perform our contract with you and as needed to enable us to enter into that contract with you. This includes taking orders, processing those orders, obtaining payment for products supplied to you and delivering products to you.

7.6 We may also process PII when it is in our or a Users’ legitimate interests to do so and when these interests are not overridden by an individual’s data protection rights. These legitimate interests include providing services to enable us to provide Users of our sites with more relevant content and to prevent fraud.

7.7 We will only use your PII for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your PII for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

7.8 Please note that we may process your PII without your knowledge or consent where this is required or permitted by law.

This may include removing you from our marketing databases where there has been no interaction between us over a prolonged period.

8 Who do we share your Information with?

8.1 We will share your PII between us as Joint Controllers and may also disclose your PII to any company in our group, which means the subsidiaries or  ultimate holding company of both Stearn Electric Company Limited and/or Blueair Inc and our subsidiaries, as defined in Section 1159 of the UK Companies Act 2006 (as amended).

8.2  Your PII will only be disclosed to those of our employees or workers that have a need for such access for the purpose for which it was collected.  Your PII will not be disclosed to any other individuals or other entities except in the following circumstances:

  • In order to protect the rights, property or safety of our business, our employees and workers, customers, suppliers and others. This includes exchanging information with other companies and organisations for the purposes of fraud prevention and credit risk reduction.
  • If we or substantially all of our assets are acquired by a third party, in which case personal data that we hold about our customers will be one of the transferred assets.

8.3 We require all third parties that process PII on our behalf to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

8.4 We only share your PII with third parties:

  • If we are under a duty to disclose or share your PII in order to comply with any legal obligation.
  • When they are hired by us or hired on our behalf, including our logistics and delivery partners: DPD, UPS, EVRi, Yodel and ShipTheory, our payment platform partners: PayPal and Lloyds, our website platform provider: Shopify, our Customer Service platform: Gnatta, and Google, Meta and Microsoft who we use to gather statistics on portions of our site. These companies – our suppliers – are contractually bound to use personal information we share with them only to perform the services we have hired them to provide.
  • To protect the rights, property or safety of us, our customers or others.
  • In order to protect the rights, property or safety of our business, our employees and workers, customers, suppliers and others. This includes exchanging information with other companies and organisations for the purposes of fraud prevention and credit risk reduction.
  • If we or substantially all of our assets are acquired by a third party, in which case personal data that we hold about our customers will be one of the transferred assets.

9 Data Retention

9.1 We will retain the PII that you provide while you remain a Customer of ours or as needed to provide you with products and services.

9.2 We will never retain PII about you for longer than is necessary to fulfil the purpose for which it was originally collected.

9.3 We may retain your PII after you have cancelled any contract with us if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, prevent fraud and abuse, or enforce this Policy and our Terms of Use. We may also retain PII for a limited period of time if requested by law enforcement agencies.

10 How do we Store and Secure Your Information?

10.1 We take the security of the data that we collect very seriously. We have implemented technical, organisational and administrative measures which are generally accepted to protect the PII in our possession and of the third parties who act on our behalf.

10.2 By providing your PII you agree to us storing or processing it. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Policy. 

10.3 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

10.4 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your PII, we cannot guarantee the security of your information transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

11 Access to Information, Opting Out and Your Privacy Rights

11.1 You have the right to access, rectify, erase, restrict, transfer, or object to the use of your information as further detailed below:

  • Request access to your PII (commonly known as a "data subject access request"). This enables you to receive a copy of the PII that we hold about you and to check that we are lawfully processing it.
  • Request rectification of the PII that we hold about you. This enables you to have any incomplete or inaccurate data that we hold about you corrected, although we may need to verify the accuracy of the new personal information that you provide to us.
  • Request erasure of your PII. This enables you to ask us to delete or remove PII where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your PII where you have successfully exercised your right to object to processing (see below), where we may have processed your PII unlawfully or where we are required to erase your PII to comply with local law. Please note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your PII where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your PII for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your PII which override your rights and freedoms.
  • Request restriction of processing of your PII. This enables you to ask us to suspend the processing of your PII in the following scenarios:
    (a) if you want us to establish the data's accuracy.
    (b) where our use of the data is unlawful but you do not want us to erase it.
    (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
    (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your PII to you or to a third party. We will provide to you, or a third party you have chosen, your PII in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your PII. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

    You can ask us to stop sending you marketing messages at any time by following the “unsubscribe” (or similar) links on any marketing message sent to you or by contacting us at any time.

    Where you opt out of receiving these marketing messages, this will not apply to PII provided to us as a result of a purchase, product/service experience or other transactions.

11.2 You may change or update the information that we hold about you at any time and as often as necessary. In the first instance, you should submit a request for a copy of your information in our possession by sending an email to sar@niuks.co.uk. We will respond to all such requests without undue delay, and in accordance with the provisions of the GDPR.

12. International Transfers

12.1 Blueair is based outside the United Kingdom and some of our staff and/or external third parties, such as Shopify, are based outside the United Kingdom so their processing of your PII will involve a transfer of data outside the United Kingdom.

12.2 Whenever we transfer your PII out of the United Kingdom, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your PII to countries that have been deemed to provide an adequate level of protection for personal data by the UK Information Commissioner’s Office.
  • Where we use certain service providers, we may use specific contracts approved by the UK Information Commissioner which give personal data the same protection it has in the UK.
  • Where we use providers based in the US, we may transfer data to them if they are part of the UK – US data bridge which requires them to provide similar protection to personal data shared between the Europe and the US.

13. Changes to this Privacy Policy

13.1 We reserve the right to modify or amend this Policy from time to time. If we change our Policy, we will post those changes on this page in addition to updating the “Last Updated” date at the bottom of this Policy. For these reasons, we encourage you to read this Policy regularly.

13.2 Your continued use of the Website or accessing Content posted on the Website shall be acknowledgement that your PII will be processed in accordance with the modified Policy. If there will be any changes made to the use of your PII in a manner materially different from that stated at the time of collection, we will notify you by posting a notice on our site. If you object to any of the changes, or the overall Policy, please contact us via sar@niuks.co.uk.
